These Terms of Service (hereinafter referred to as "the Terms") apply to the animation and illustration production services (hereinafter referred to as "the Services") provided by Pekkori Puff (hereinafter referred to as "the Provider") to users (hereinafter referred to as "the Client").

By using the Services, the Client is deemed to have agreed to these Terms.

 

 1. Conditions for Providing the Services

The Services are intended for use with Vtuber characters for which the User holds the copyright, or has obtained formal permission for usage and secondary usage from the copyright holder.

The Provider does not guarantee that the User is using the Services without infringing the rights of third parties.

 

 2. License and Restrictions

The use of the animation and illustrations created by the Provider (hereinafter referred to as "the Work") is limited to the following purposes:

Permitted Uses:

• Streaming on the Client's Vtuber activities (e.g., Twitch, YouTube)

• Posting on social media

Prohibited Uses:

• Use outside of streaming activities and social media

• Modification, redistribution, sale, or resale of the Work

• Use in NFTs or blockchain-related activities

If the Client wishes to use the Work for purposes other than those listed above, prior consultation with the Provider is required.

The Provider may publish or introduce the Work on their website or social media. If the Client does not wish for this, the Client must notify the Provider in advance.

 

 3. Copyright and Use of Reference Materials

Copyright for the Work created by the Provider is limited to the animations and illustrations, and does not affect the copyright or intellectual property (IP) rights of the Client's Vtuber character.

If the Client uses reference materials (such as existing illustrations, animations, photos, videos, etc., hereinafter referred to as "Reference Materials") created by others, the Client guarantees that no copyright infringement will occur.

The Provider may use Reference Materials submitted by the Client to create the Work, but will ensure that the creation process does not infringe on the copyright of the Reference Materials. The Client is responsible for confirming that the Reference Materials do not infringe on any third-party rights and obtaining permission to use them if necessary.

If the Provider determines that the Work is very similar to the reference materials provided by the Client or lacks creativity, the Provider will consult with the Client and take copyright considerations into account.

 

 4. Delivery and Publication of Work

Delivery deadlines will be set in Japan Standard Time (JST).

The work created by the provider will be published on the provider's social media, etc., after the client has published it.

 

 5. Force Majeure

In the event of delays or cancellations due to natural disasters, societal disturbances, communication failures, or other force majeure events, the Provider shall not be held responsible.

 

 6. Workflow and Revisions

The standard workflow varies depending on the type of project:

• Frame-by-Frame Animation: Rough sketch → Storyboard → Animation production & Background illustration → Coloring & Final adjustments

• Keyframe Animation: Rough sketch → Illustration production → Animation production

• Illustration: Rough sketch → Illustration production

The Client is entitled to two free revisions per production phase.

Additional charges will apply for revisions beyond the second.

If significant revisions or changes are required, the Client should raise the issue during the rough sketch or storyboard stage.

 

 7. Delays in Response and Cancellations

If the Client does not respond to the Provider's communication within 3 days (72 hours), the transaction may be canceled, or the production may move to the next stage.

If delays in the Client's response result in a delay in the delivery or changes to the revision process, the Provider shall not be held responsible.

 

 8. Payment, Cancellation, and Refunds

Payment method: PayPal only

Payment timing: Full payment in advance (within 48 hours of PayPal invoice issuance)

Refund policy: No refunds under any circumstances

 

 9. Confidentiality

Both the Provider and the Client agree not to disclose or leak any personal or confidential information learned during the transaction to third parties.

 

 10. Disclaimer

The Provider is not responsible for any damage or loss caused by the Client's use of the Work.

If the Client infringes on the rights of a third party, the Client will be fully responsible for such actions.

 

 11. Governing Law and Jurisdiction

These Terms are governed by and interpreted in accordance with Japanese law. In the event of any dispute concerning these Terms, the Tokyo District Court (or the court in the Provider's jurisdiction) shall have exclusive jurisdiction as the court of first instance.
